TOPEKA, Kan. — A 34-year-old man arrested in connection with allegations of aggravated assault, domestic battery and interference with law enforcement is also being held for U.S. Immigration and Customs Enforcement (ICE), according to jail booking records dated November 2.
Jose Israel Vargas-Cruz, born August 25, 1992, was booked into custody at approximately 3 a.m. Monday under booking number 2026-00007446.
According to the booking report, Vargas-Cruz faces three listed allegations:

- Aggravated assault: Use of a deadly weapon.
- Interference with law enforcement: Obstructing, resisting or opposing the service or execution of a felony warrant.
- Domestic battery: Rude physical contact involving a family member or someone in a dating relationship, with the booking description referencing a second offense within five years.
All three allegations appear under warrant number 2026-90022, with a $25,000 bond listed for each entry. The report does not establish whether those amounts are cumulative or reflect a single bond.
In addition to the criminal allegations, the booking report lists a separate hold for Immigration and Customs Enforcement under reference number A245459084. The ICE hold is designated “NO BOND.”
An ICE hold can involve a request by federal immigration authorities to maintain custody of an individual for potential immigration enforcement proceedings. However, the booking record does not establish Vargas-Cruz’s citizenship, immigration status or the specific circumstances surrounding the federal hold.
Vargas-Cruz is scheduled to appear in court on December 3, 2026, at 3 p.m., according to the booking record.
The circumstances surrounding the alleged assault, including whether anyone was injured or what weapon was allegedly involved, were not detailed in the report.
The allegations have not been proven in court, and Vargas-Cruz is presumed innocent unless and until proven guilty.
This Is Topeka will continue following the case as additional court records and information become available.
