Brandt faces an aggravated-battery allegation involving knowingly causing great bodily harm or disfigurement. His booking record lists him as being held without bond.

The arrest follows an October 9 shooting in the northwest parking lot of Sam’s Club, located at 1401 SW Wanamaker Road, that left an adult man hospitalized with life-threatening gunshot wounds.

Police responded to the scene at approximately 3:59 p.m. Friday. Officers located the injured man, who was transported to a local hospital for emergency treatment.

Eyewitness describes confrontation before gunfire

An eyewitness who spoke with WIBW described what appeared to be a road-rage confrontation between two drivers before the shooting.

According to the witness, one driver began yelling at another motorist and repeatedly approached the other vehicle. The witness reported seeing the individual strike the vehicle’s windshield and later punch the driver through an open window.

The witness said the driver inside the vehicle subsequently fired a gun.

According to that account, the person who fired remained at the scene until police arrived.

Police have not publicly confirmed the eyewitness’s version of events or established whether the shooting involved self-defense. The witness’s account remains an allegation about how the confrontation unfolded, rather than an official determination of responsibility.

Investigators have also not publicly clarified the sequence of events leading to Brandt’s arrest.

Booking records confirm aggravated-battery allegation

Shawnee County detention records identify the arrested man as Joshua Cain Smith Brandt, born June 19, 1978.

Brandt was booked at 3:20 a.m. Saturday, October 10, under booking number 2026-00006993.

The booking lists warrant 2026-82990 and one allegation: aggravated battery involving knowingly causing great bodily harm or disfigurement.

The record shows no bond at the time of booking and does not list a release date.

As of October 12, the Topeka Capital-Journal reported that prosecutors had not filed formal criminal charges. The booking allegation should not be confused with a conviction or a final charging decision.

Questions remain about what happened

The eyewitness account raises important questions about the moments before the gunfire, including whether the shooting followed an assault and how investigators are evaluating the actions of those involved.

Those questions remain unanswered publicly.

Police have not identified the wounded man or provided an updated medical condition. Authorities also have not announced whether additional charges or arrests are anticipated.

The shooting occurred during a busy Friday afternoon at one of west Topeka’s major shopping destinations.

The Topeka Police Department continues to investigate and is asking anyone with information to contact its Criminal Investigation Bureau at 785-368-9400 or email [email protected].

Anonymous information can also be submitted to Shawnee County Crime Stoppers at 785-234-0007.

Brandt is presumed innocent unless and until proven guilty in court.

This Is Topeka will continue following the investigation, including any formal criminal charges, updates on the injured man’s condition and additional findings about the confrontation that preceded the shooting.
