TOPEKA, Kan. — A Topeka man with a history of serious criminal allegations is back behind bars after his arrest last night on charges of aggravated endangering a child and criminal possession of a weapon by a felon.
According to booking records, 31-year-old Alfred Antonio Smith was taken into custody at 7:10 p.m. on September 17 and booked into the Shawnee County Jail. His bond was set at $50,000 cash or professional surety.
The Charges
Smith faces one count of aggravated endangering a child, alleging that he recklessly placed a child under 18 in a dangerous situation. He also faces one count of criminal possession of a firearm by a convicted felon, an offense that carries additional penalties since it occurred within eight years of his last conviction or diversion.
Both charges are felonies under Kansas law and could result in significant prison time if convicted.

History of Serious Allegations
Smith’s name is familiar to Topeka residents. Public court records show he was charged in 2019 with aggravated domestic battery, domestic battery, and criminal damage to property — all of which were dismissed without prejudice at the preliminary hearing.
In 2023, Smith was taken into custody in Missouri after Topeka police sought him in connection with the shooting death of a two-month-old infant on SW Mulvane Street. Authorities have not released the disposition of that case, leaving questions about whether charges were pursued or dropped.
Concerns About ‘Catch and Release’
Smith’s re-arrest reignites community frustration over what some call a “catch and release” cycle in Shawnee County, where individuals facing violent charges are repeatedly released back into the community.
Critics say that without stricter enforcement or more aggressive prosecution, the public — including children — remains at risk. Advocates for reform argue that pretrial detention decisions must balance due process with community safety, but cases like this raise concerns about whether the balance has tipped too far.
What’s Next
Smith remains in custody pending his first court appearance in case number 25CR534. Hearing dates are expected to be announced soon.
