TOPEKA — A routine DUI arrest in Topeka this week took a turn that is becoming increasingly familiar nationwide: an immigration hold.

According to the Shawnee County booking record, Luis Alberto Bermudez, 30, was arrested late Monday night, Jan. 27, and booked on multiple traffic-related charges, including DUI (.08 or greater within three hours), driving without a license, no proof of insurance, and following too closely. Each of the traffic counts carries a $5,000 personal recognizance bond, with a scheduled court appearance on Feb. 4.

In addition to the state charges, the booking shows a “Hold for Immigration and Customs Enforcement”, commonly referred to as an ICE hold. Unlike the traffic offenses, the ICE hold lists no bond, meaning Bermudez may not be released even if he otherwise qualifies under state law.

ICE holds—also known as immigration detainers—are civil requests issued by U.S. Immigration and Customs Enforcement asking local jails to keep an individual in custody for up to 48 hours beyond their scheduled release so federal agents can assume custody. They are not criminal warrants and are not reviewed by a judge at the time they are issued.

Kansas does not have a statewide law either requiring or prohibiting compliance with ICE detainers, leaving decisions largely to local agencies and jail administrators. Civil rights groups and legal scholars have long debated the practice, noting that detainers can result in people being held without new criminal charges solely on the basis of suspected immigration status.

Local officials have repeatedly emphasized that traffic enforcement and criminal charges are handled independently from federal immigration policy. Still, cases like this highlight how quickly a traffic stop can escalate into a federal immigration matter—often with life-altering consequences.

At this stage, there is no public information indicating whether ICE agents have taken custody of Bermudez or whether removal proceedings have been initiated. An ICE hold does not itself establish immigration status, nor does it determine the outcome of any immigration case.

What is clear is that the addition of an ICE detainer fundamentally changes the trajectory of what would otherwise be a standard DUI case—transforming a local criminal matter into a federal civil enforcement issue.

As Topeka continues to navigate questions about policing, public safety, and community trust, ICE holds remain one of the most contentious fault lines between local law enforcement and federal immigration authorities.
